כל עוד לא נתנו חוקים על ידי מועצת המדינה הזמנית או על פיה, יעמוד בתקפו במדינת ישראל המשפט שהיה קיים בארץ ישראל ביום ה׳ באייר תש״ח (14 במאי 1948), עד כמה שהדבר עולה בד בבד עם האמור במנשר הזה, עם החוקים העתידים ועם השנויים הנובעים מהקמת המדינה ורשויותיה.
