4. היצירות שבהן יש זכות יוצרים
(א)זכות יוצרים תהא ביצירות אלה:
(1)יצירה מקורית שהיא יצירה ספרותית, יצירה אמנותית, יצירה דרמטית או יצירה מוסיקלית, המקובעת בצורה כלשהי;
(2)תקליט;
ובלבד שהתקיים לגבי היצירות האמורות אחד התנאים הקבועים בסעיף 8 או שיש בהן זכות יוצרים מכוח צו לפי סעיף 9.
(ב)לעניין סעיף קטן (א), מקוריות של לקט היא המקוריות בבחירה ובסידור של היצירות או של הנתונים שבו.
