2. האזנת סתר שלא כדין ושימוש שלא כדין בהאזנה
תיקון: תשנ״ה
(א)המאזין האזנת סתר שלא על פי היתר כדין, דינו – מאסר חמש שנים.
(ב)המשתמש ביודעין וללא סמכות כדין בידיעה או בתכנה של שיחה שהושגו על ידי האזנת סתר, בין שנעשתה כדין ובין שנעשתה שלא כדין, או מגלה ידיעה או תוכן שיחה כאמור ביודעין לאדם שאינו מוסמך לקבלה, דינו – מאסר חמש שנים.
(ג)המציב או המתקין מכשיר למטרת האזנת סתר שלא כדין או כדי לאפשר שימוש בו למטרה האמורה, דינו – מאסר חמש שנים.
