3. האזנה למטרת עבירה או גרימת נזק
תיקון: תש״ם
האזנה לשיחה והקלטתה, אף שהן נעשות בהסכמת אחד מבעלי השיחה – אסורות, ודינן כדין האזנת סתר, אם נעשו למטרת ביצוע עבירה או מעשה נזק, או למטרת גילוי דברים שבינו לבינה והם מצנעת האישות ושלא לצורך הליך משפטי בין בני זוג.
