3. כשרות לרשת: בני־אדם
(א)כל מי שהיה בחיים במות המוריש כשר לרשת אותו.
(ב)מי שנולד תוך 300 יום לאחר מות המוריש, דינו כדין מי שהיה בחיים במות המוריש, זולת אם הוכח שהורתו היתה אחרי כן.
(ג)לענין זכויות הירושה של ילד אין נפקא מינה אם בשעת לידתו היו הוריו נשואים זה לזה, ואם לא.
