44. יורש על תנאי מפסיק
(א)המצווה רשאי לצוות שיורש יחדל מלזכות בהתקיים תנאי או בהגיע מועד.
(ב)לא קבע המצווה מי יזכה בהתקיים התנאי או בהגיע המועד, יזכו יורשיו על פי דין כיורשים אחרי אותו יורש בהתאם להוראות סעיף 42.
