2. פטור מהשבה
בית המשפט רשאי לפטור את הזוכה מחובת ההשבה לפי סעיף 1, כולה או מקצתה, אם ראה שהזכיה לא היתה כרוכה בחסרון המזכה או שראה נסיבות אחרות העושות את ההשבה בלתי צודקת.
