משבוטל חיקוק, בטלים עמו התקנות והמינויים שנעשו מכוחו; אולם מקום שהחיקוק המבטל קובע הוראות במקום המבוטלות – התקנות והמינויים שנעשו מכוח ההוראות המבוטלות יעמדו בתקפם עד שיבוטלו בתקנות ובמינויים מכוח החיקוק המבטל.
