3. אפוטרופסות שווה
(א)האם והאב כאחד הם האפוטרופסים הטבעיים על ילדיהם; מת אחד ההורים, הנשאר בחיים הוא האפוטרופוס הטבעי.
(ב)אין בהוראות סעיף קטן (א) כדי לפגוע בכוחו של בית משפט או בית דין מוסמך לנהוג בעניני אפוטרופסות על ילדים, הן על גופם והן על רכושם, בהתחשב עם טובת הילדים בלבד.
