על אף האמור בסעיפים 31 ו־32, לא יורה הנציב בצו על הקמת צוות כיבוי והצלה מפעלי או על צוות כיבוי לשטחים פתוחים בגוף ביטחוני המפעיל מערך כיבוי עצמאי, אלא בהסכמת השר הממונה.
