3. יצירת הערבות
הערבות נוצרת בהסכם בין הערב לבין הנושה או בהתחייבותו של הערב שהודעה עליה ניתנה לנושה; ואם היתה הערבות על פי צו של רשות – משנמסר כתב הערבות לרשות.
