8. אחריות הערב
הערב והחייב אחראים כלפי הנושה יחד ולחוד, אולם אין הנושה רשאי לדרוש מן הערב מילוי ערבותו בלי שדרש תחילה מן החייב קיום חיובו, אלא באחת הנסיבות האלה:
(1)הערב ויתר על הדרישה מן החייב;
(2)ניתן נגד החייב צו קבלת נכסים או צו פירוק;
(3)החייב מת או נמצא מחוץ לישראל או שמתן הדרישה כרוך בקשיים מיוחדים.
