139. רישום הפלוגתה והדיון בה

נוכח בית המשפט, לאחר שחקר בדבר כפי שנראה לו, כי נתקיימו שלושה אלה:
(1)ההסכם הנזכר בתקנה 138 נחתם כהלכה בידי בעלי הדין;
(2)לבעלי הדין יש ענין של ממש בהכרעת השאלה כאמור;
(3)השאלה ראויה שידונו ויכריעו בה,
יעמיד את הפלוגתה לדיון ויתן פסק דין בהתאם לתנאי ההסכם.
