בית המשפט בדונו בהמרצת פתיחה רשאי להורות על הבאת ראיות נוספות בתמיכה להמרצת הפתיחה, ככל שיראה צורך בכך, לרבות השמעת עדים, ורשאי הוא להורות בדבר בירור הפלוגתות המתעוררות בה ככל שייראה לו.
