תובענה להחזרת ילד לחוץ לארץ לפי האמנה תוגש במסירת כתב תביעה (להלן – התביעה) לבית המשפט שבתחום שיפוטו מצוי הילד; לא היה המקום ידוע לתובע יחולו הוראות תקנה 258ג.
