תיקון: תשנ״ו
בית המשפט רשאי בפסק הדין להביא בחשבון בשיקוליו, החלטה שיפוטית או מינהלית שניתנה במדינה שבה נמצא מקום מגוריו הקבוע של הילד, גם אם לא נתמלאו התנאים לכך לפי סעיף 11 לחוק אכיפת פסקי חוץ, התשי״ח–1958.
