44. תובענה תכיל מלוא הסעד
[44, 45]
(א)תובענה תכיל את מלוא הסעד שהתובע זכאי לו בשל עילת התובענה; אך רשאי תובע לוותר על חלק מהסעד כדי להביא את התובענה בתחום שיפוטו של בית המשפט.
(ב)תובע שלא כלל בתובענה חלק מהסעד או ויתר עליו, לא יגיש אחרי כן תובענה בשל חלק זה.
