הטוען כוונה רעה, כוונת מרמה, ידיעה, וכיוצא באלה שבלבו של אדם, והטענה היא מהותית במשפט, די לטוען שיטען אותה בחזקת עובדה, ואין עליו לפרש את הנסיבות שמהן ניתן להסיקה.
