היה בית המשפט סבור כי טענת עובדה שהוכחשה או שלא הודו בה, מן הראוי היה שיודו בה, רשאי הוא ליתן כל צו שייראה לו צודק בענין הוצאות יתרות שנגרמו עקב ההכחשה או אי־ההודיה.
