סבר עובד סוציאלי לפי חוק האימוץ או משפטן כי בנסיבות העניין אין לקבל את הסכמת ההורה למסירת ילדו לאימוץ, וההורה מבקש למסור את ילדו לאימוץ, יעביר את בקשת ההורה להכרעת בית המשפט.
