Section 3 of חוק בדבר מניעתו וענישתו של הפשע השמדת עם, תש״י–1950, קשר, הסתה ונסיון להשמדת עם, והשתתפות בה.
3. קשר, הסתה ונסיון להשמדת עם, והשתתפות בה
(א)האשם באחד המעשים המפורטים להלן, דינו כדין האשם בהשמדת עם. ואלה המעשים:
(1)קשר לבצע השמדת עם;
(2)הסתה לבצע השמדת עם;
(3)נסיון לבצע השמדת עם;
(4)השתתפות בהשמדת עם.
(ב)המונחים ”קשר“, ”הסתה“ ו”נסיון“ שבסעיף קטן (א), יש לפרשם מתוך סמוכין להוראות פקודת החוק הפלילי, 1936.
(ג)לצורך סעיף קטן (א)(4), רואים אדם כמשתתף בהשמדת עם, אם רואים אותו כך על פי סעיף 23(1)(ב), (ג) או (ד) לפקודת החוק הפלילי, 1936.
