נמצא בחזקתו של אדם, ברשותו, או בכלי רכב, כלי שיט או כלי טיס שבבעלותו או בחזקתו ושאינו רכב ציבורי, ערך טבע מוגן, עליו הראיה שהוא מחזיק בו כדין.
