16. ערעור על עיצום כספי
תיקון: תשפ״ד
(א)על דרישה לתשלום עיצום כספי ניתן לערער בפני בית משפט שלום.
(ב)הערעור יוגש בתוך 30 ימים מהיום שהודע על הטלת העיצום הכספי.
(ג)אין בערעור כדי לעכב תשלום העיצום הכספי אלא אם כן הורה הממונה או בית המשפט אחרת.
(ד)התקבל הערעור, יוחזר הסכום ששולם בתוספת ריבית שקלית מיום תשלומו ועד יום החזרתו, ויחולו הוראות חוק פסיקת ריבית והצמדה לעניין ריבית זו, בשינויים המחויבים.
(ה)על החלטת בית המשפט בערעור ניתן לערער ברשות, ובית המשפט ידון בערעור בשופט אחד.
