41ב. הגנות
תיקון: תשנ״ב
בתובענה לפי סימן זה לא תהא הגנה לבעלים, אלא אם כן הנזק נגרם עקב אחד מאלה –
(1)התגרות של הניזוק בכלב;
(2)תקיפת הניזוק את הבעלים, את בן זוגו, הורו או ילדו;
(3)הסגת גבול של הניזוק במקרקעין של הבעלים.
