48ב. שימוש הדרוש לטובת הציבור
תיקון: תשכ״ט־2
שימוש במקרקעין הדרוש לטובת הציבור לא יהיה בו מיטרד לענין סימן זה, אף אם הוא גורם נזק למקרקעין שכנים או מונע מבעליהם הנאה מלאה ממקרקעיהם, ובלבד שהנזק שנגרם אינו חורג מתחום הנסבל והמשתמש נקט אמצעים סבירים כדי להקטין את הנזק ככל האפשר; אולם רשאי בית המשפט לפסוק פיצויים – אם בתשלום חד פעמי ואם בתשלומים חוזרים – אם נגרם לבעל המקרקעין נזק ממון.
