87. העברת המשכנתה
(א)בכפוף למוסכם בתנאי המשכנתה רשאי בעל המשכנתה להעביר את המשכנתה, או חלק ממנה, לאדם אחר, יחד עם החוב המובטח על ידיה, כולו או מקצתו, ללא הסכמת בעל המקרקעין.
(ב)הועברה המשכנתה ולא נודע לחייב על ההעברה, מופטר הוא על ידי תשלום החוב לבעל המשכנתה הקודם.
