בסכסוך עבודה שבין מעסיק לעובדיו או לחלק מהם, הצדדים לסכסוך הם המעסיק וארגון העובדים המייצג את רוב העובדים שהסכסוך נוגע להם, ובאין ארגון עובדים כאמור – הנציגות שנבחרה על־ידי רוב העובדים האלה בין לכל ענין ובין לסכסוך העבודה הנדון.
