5. העברת זכויות וחובות
(א)זכויותיו וחובותיו של בעל הזכיון לפי חוזה הזכיון ניתנות להעברה או לשיעבוד, אולם העברתן או שיעבודן טעונות הסכמה מראש של שר האוצר.
(ב)העברת שליטה בבעל הזכיון טעונה הסכמה מראש של שר האוצר; לענין זה, ”שליטה“ – כהגדרתה בסעיף 1 לחוק ניירות ערך, התשכ״ח–1968.
