6. הגדרה
לענין סימן זה, ”הפרה יסודית“ – הפרה שניתן להניח לגביה שאדם סביר לא היה מתקשר באותו חוזה אילו ראה מראש את ההפרה ותוצאותיה, או הפרה שהוסכם עליה בחוזה שתיחשב ליסודית; תניה גורפת בחוזה העושה הפרות להפרות יסודיות ללא הבחנה ביניהן, אין לה תוקף אלא אם היתה סבירה בעת כריתת החוזה.
