40. חלוקת יתרת הרוחים
בהתחשב עם הוראות סעיף 39, מותר לחלק בכל שנה בין החברים את יתרת הרוחים של אגודה, לאחר שתעשה ההפרשה הקבועה לקרן השמורה, יחד עם כל ריוח שנצטבר משנים חולפות. ואם האגודה היא אגודת יצרנים או אגודת צרכנים, מותר לחלק את היתרה הנ״ל גם בין שאינם חברים עד לשעור ועפ״י התנאים שנקבעו בתקנות שעפ״י פקודה זו או בתקנות של אותן האגודות.
