בהכרעה בין פירוק בידי בית המשפט לבין פירוק בפיקוח, ובמינוי מפרקים, ובכל שאר ענינים השייכים לפירוק בפיקוח, יתחשב בית המשפט במשאלותיהם של הנושים והמשתתפים כפי שהוכחו לו על יסוד ראיות מספיקות.
