363. שמירת זכות וחבות לפי חוזה שויתרו עליו

בית המשפט רשאי, לפי בקשת אדם הזכאי או החייב כלפי המפרק לפי חוזה שנעשה עם החברה, ליתן צו המבטל את החוזה בתנאים שקבע לענין תשלומי פיצויים בין הצדדים בשל אי־ביצוע החוזה ולכל ענין אחר, כפי שייראה לו צודק, ופיצויים שנפסקו כאמור יהיו למבקש חוב בר־תביעה בפירוק.
