5. הודעות טרם הגשת תובענה
לא יגיש אדם תובענה לפי סעיף 2, אלא לאחר שעברו 60 ימים מהיום שהוא הודיע לרשות ולגורם המפגע על כוונתו להגיש תובענה, והתקיימו שניים אלה:
(1)גורם המפגע לא נקט צעדים ממשיים להפסקת המפגע הסביבתי או למניעת הישנותו או לתיקון המעוות, לפי הענין;
(2)הרשות לא נקטה צעדים ממשיים על־פי סמכויותיה להפסקת המפגע הסביבתי או למניעת הישנותו או לתיקון המעוות, לפי הענין.
