5. עונשין
(א)המוכר או המספק דלק בניגוד להוראות סעיף 2, דינו – מאסר שישה חודשים או קנס פי עשרה מן הקנס כאמור בסעיף 61(א)(3) לחוק העונשין, התשל״ז–1977 (בחוק זה – חוק העונשין).
(ב)הורשע אדם במכירה או באספקה של דלק בניגוד להוראות סעיף 2, רשאי בית המשפט להורות על מחיקת מבצע העבירה מהמרשם, לתקופה ובתנאים כפי שימצא לנכון.
