3. הקטנת שיעור הפיצויים
תיקון: תשע״ח
קבע בית המשפט לפי הוראות סעיף 2(א)(1) כי בעל דירה מסרב אחראי בנזיקין כלפי שאר בעלי הדירות במקבץ לפינוי ובינוי, רשאי הוא, אם ראה שמן הצדק לעשות כן, לקבוע כי בעל הדירה המסרב יישא רק בחלק מנזקם של בעלי הדירות; לענין זה, בית המשפט ישקול, בין השאר, שיקולים אלה:
(1)גובה הנזק שנגרם לבעלי הדירות המסכימים לעסקת הפינוי ובינוי;
(2)כושר פירעונו של בעל הדירה המסרב לשאת בנזק;
(3)נסיבות העסקה.
