מי ששר הבריאות הסמיכו לכך בכתב רשאי, אם הוא משוכנע שהדבר דרוש כדי להבטיח את קיום הוראות סעיף 9, להיכנס לכל מקום ממכר, ייצור או החסנה של מוצרי עישון ולתפוס מוצרי עישון שעל חפיסותיהם או אריזותיהם אין אזהרה; מוצרי עישון שנתפסו כאמור יוחזרו רק לאחר שבעליהם ידביקו עליהם אזהרה.
