לא יתקין אדם באר אלא לפי רשיון מאת מנהל הרשות הממשלתית ובהתאם לתנאי הרשיון (בחוק זה – רשיון קדיחה); מתן רישיון לפי סעיף זה וקביעת תנאים בו ייעשו על פי כללים שקבעה ממועצת הרשות הממשלתית.
