61. שמירת אחריות פלילית
תיקון: תשפ״ד
(א)תשלום עיצום כספי לא יגרע מאחריותו הפלילית של אדם בשל הפרת הוראה המנויה בסעיף 53.
(ב)הוגש נגד אדם כתב אישום בשל עבירה, לא יחויב בשל המעשה המהווה את העבירה בתשלום עיצום כספי, ואם שילם – יוחזר לו הסכום ששולם בתוספת ריבית שקלית מיום תשלומו עד יום החזרתו, ויחולו הוראות חוק פסיקת ריבית והצמדה לעניין ריבית זו, בשינויים המחויבים.
