על אף הוראות סעיף 39(א), פסק של המפקח הכללי בשבתו כדן יחיד, או פסק של רב־ניצב או שופט שיצא לקצבה, שאליו הועבר הדיון לפי הוראות סעיף 28(ג)(2), הוא פסק חלוט כמשמעותו בסעיף 40א.
