35. הנחיות לא ברורות או לא מתאימות
לא ניתן לקבוע בבירור את רצונו של החולה הנוטה למות מההנחיות הרפואיות המקדימות שנתן, או שההנחיות הרפואיות אינן מתאימות לנסיבות המקרה, או בהעדר מיופה כוח או עדות ברורה של אדם קרוב – תכריע בדבר הוועדה המוסדית.
