12. אישור לפעולה טעונת הסכמה
היתה פעולה של אחד מבני הזוג טעונה, לפי הסכם ממון או לפי צו בהתאם לסעיף 11(2), הסכמת בן הזוג השני ואותו בן זוג סירב להסכים, רשאי בית המשפט או בית הדין לאשר את הפעולה אם ראה שהסירוב היה שרירותי; לא יכול היה בן הזוג השני להביע דעתו או שלא היתה אפשרות סבירה לברר דעתו, רשאי בית המשפט או בית הדין לאשר את הפעולה אם ראה שהיא לטובת המשפחה.
