מבקש שאינו ממשיך בשקידה ראויה בהליכי בקשת פשיטת רגל שהגיש, רשאי בית המשפט להחליפו בנושה אחר הנושה בחייב סכום הנדרש לפי פקודה זו לענין נושה המגיש בקשת פשיטת־רגל.
