3. אחריות מנהל ועובד
תיקון: תשמ״ז, תשנ״ח, תשס״ב, תשס״ב־2
(א)עבר גוף ציבורי על הוראות סעיפים 2 או 2ב, יאשם בעבירה אדם אשר בשעת ביצוע העבירה היה מנהל פעיל, חשב או פקיד אחראי בו, וכל מי שייצג את הגוף הציבורי בעסקה, אלא אם כן הוכיח שהעבירה נעברה שלא בידיעתו ושנקט כל האמצעים הסבירים להבטחת קיום הוראות הסעיף האמור.
(ב)מי שעבר עבירה כאמור בסעיף קטן (א), דינו – קנס.
