4. זכאות בני זוג
(א)הזכאות לגימלה של כל אחד מבני זוג מותנית בכך שמתקיימים גם בבן זוגו תנאי הזכאות לפי סעיף 2.
(ב)האמור בסעיף קטן (א) לא יחול על מי שהשר קבע בתקנות, בתנאים שקבע.
