52ו. מידע שאינו מידע פנים
תיקון: תשמ״א
(א)אין רואים מידע כמידע פנים אם נמסר לרשות או לבורסה דו״ח על המידע והרשות או הבורסה פרסמו אותו, או ניתן לו פרסום בדרך אחרת המקובלת לצורך הבאת מידע מעין זה לידיעת הציבור, ועבר יום מסחר בבורסה לאחר יום הפרסום כאמור; לא פרסמו הרשות או הבורסה את המידע תוך ארבעה ימים מיום שדווח עליו, יחדל המידע להיות מידע פנים בתום תקופה זו.
(ב)הטוען כי מידע נמסר או ניתן לו פרסום כאמור בסעיף קטן (א) עליו הראיה.
