הוראות פרק זה לא יחולו על חברה המתפרקת מרצון רק לשם שינוי מבנה או לשם התמזגות עם חברה אחרת, או על מקרה שחל עליו סעיף 9(1), (2) ו־(4) לפקודת הפיצויים לעובדים, 1947.
