1. שמירה ושומרים
(א)שמירת נכס היא החזקתו כדין שלא מכוח בעלות.
(ב)השומר נכס שאין לו בשמירתו טובת הנאה לעצמו, הוא שומר חנם.
(ג)השומר נכס המקבל תמורה בעד השמירה או שיש לו בשמירתו טובת הנאה אחרת לעצמו, ואיננו שואל, הוא שומר שכר.
(ד)השומר נכס כדי להשתמש בו או ליהנות ממנו בלי ליתן תמורה, הוא שואל.
