12. מעמד המוטב
(א)נקבע מוטב שאינו המבוטח, תהיה הזכות לתגמולי הביטוח למוטב; אין בהוראה זו כדי לגרוע מזכותו של המבוטח לתבוע מן המבטח לשלם את תגמולי הביטוח למוטב.
(ב)טענה שהמבטח יכול לטעון כלפי המבוטח תעמוד לו גם כלפי המוטב, והוא רשאי לקזז מתגמולי הביטוח דמי ביטוח המגיעים לו לפי אותו חוזה.
