6. תביעת מזונות וגבייתם
תיקון: תשע״א, תשע״ח
(א)במידה שנזקק לא תבע מזונות מחייב או לא גבה אותם, זכאים שר הרווחה והשירותים החברתיים או רשות מקומית לתבוע ולגבות אותם בשם הנזקק על פי הרשאתו, או אף ללא הרשאתו אם הוא קטין או חולה־נפש או נמצא בטיפול סוציאלי של מחלקה לשירותים חברתיים.
(ב)שר הרווחה והשירותים החברתיים או רשות מקומית שגבו מזונות, ימסרו אותם לנזקק או ישתמשו בהם, לפי הוראת בית המשפט שפסק את המזונות, לצרכיו של הנזקק; במידה שלא ראו צורך או אפשרות להשתמש בהם כך – יחזירום לחייב.
