41. זכות כריה כיצד היא ניתנת
(1)זכות כריה אפשר לה שתנתן בדרך מתן זכות כריה או בדרך מתן חוזה חכירה לכריה או לכרית שמן.
(2)על המפקח להחליט לפי מסבות הענין אם רצוי שהכריה תתנהל בתוקף זכות כריה או בתוקף חוזה חכירה לכריה.
